Intellectual Property

When it comes to intellectual property law, WBM represents clients in a diverse range of missions, brands, and technologies. Serving both individuals and businesses, we protect our clients’ intellectual property by utility and design patents, registered and unregistered trademarks, trade names and trade dress, copyrights, trade secrets, and unfair competition law.

A Practice as Diverse as Our Clientele

Just as our clients have a wide range of businesses, we have particular experience in the mechanical arts, electromechanical processes, immunochemistry, pharmaceuticals, the creative arts and advertising, and the trucking and transportation industry.

We’re Not Litigators. We’re Trial Lawyers.

Unlike stereotypical lawyers, we are not “litigators.” We are trial lawyers who know how to deal with juries, judges, experts, and witnesses in the courtroom, where we fully understand the risks as well as the potential rewards to our clients’ interests. As a result, we bridge legal expertise with real life, hands-on experience to provide practical advice about when, where, and whether to engage in or to avoid litigation. When litigation is advisable or unavoidable, we prepare our cases to win. In addition, we provide counseling and advice concerning copyright and trademark registration, licensing, and pharmaceutical product development.

Personal Experience & Passion

Over the past 40 years, the members of WBM’s Intellectual Property Practice Group have tried, won, and settled cases in every major area of intellectual property. Partner and Group Chair David L. Applegate is in his fourth decade of trying and winning cases in both state and federal courts, with extensive arbitration and mediation experience. Partner and Group Member Partner Paul J. Ripp is registered to practice before the Patent and Trademark Office, with significant trial, discovery, arbitration, and Inter Partes Review experience. Together with top-flight associates, WBM can handle any intellectual property case from start to finish.

Patents, Trademarks, and Copyrights

Together or separately, we have tried or prepared for trial patent infringement cases in technologies as diverse as toy design and manufacturing, soil remediation, and pharmaceutical products. In the trademark and trade dress area, we have represented or challenged owners of both famous and new marks in various industries including food and beverage, industrial supply, and healthcare. In the copyright sphere we have both represented and challenged owners in all arenas, and have handled related claims involving counterfeiting, unfair trade practices under the Lanham Act, state laws, and the common law, among many others.
